It's a captain's job to operate his vessel safely. In the open ocean, these vessels have no business being within 500 metres of each other. According to the International Regulations for Preventing Collisions at Sea section 15, “When two power-driven vessels are crossing, the vessel which has the other on the starboard [right-hand] side must give way.”
